Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of CalledIt (the "Service"), operated by the CalledIt team ("we", "us"). By creating an account, ticking the acceptance box at signup, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Disclaimer. If you do not agree, do not use the Service.

2. Who can use CalledIt

You must be at least 18 years old and able to form a binding contract. The Service is intended for users in jurisdictions where it is lawful. You are responsible for keeping your account credentials secure and for all activity under your account.

3. What CalledIt is — and is not

CalledIt is an information and accountability tool. It computes and displays the historical, methodology-based performance of publicly-made market commentary on X. CalledIt is not an investment adviser, broker-dealer, or financial planner; it is not registered with the SEC or any state securities authority; and nothing on the Service is investment, legal, tax, or financial advice. See the Disclaimer. Do not make investment decisions solely on the basis of anything you see here. You alone are responsible for your own investment decisions and assume all risk of loss; any action you take based on the Service is taken entirely at your own risk.

4. Accounts

You sign in with an email address and either a password or a one-time email link. You may close your account at any time. We may suspend or terminate accounts that violate these Terms.

5. Searches, credits & billing

Free searches

Free accounts include a limited number of searches per rolling 30-day period (currently 3). Free searches cover handles we have already analyzed; running a brand-new handle requires a credit.

Credits

  • Credits are bought as one-time purchases (no subscription) through our payment processor.
  • A search against a new (never-analyzed) handle consumes 1 credit; a search against an already-analyzed handle consumes 0.25 credit. Current pack prices are shown in the app.
  • Credits do not expire, are not redeemable for cash, have no monetary value outside the Service, and are non-transferable.
  • Purchases are generally non-refundable except where required by law. If a paid analysis fails to produce a result due to a fault on our side, contact us and we will restore the credit.

Payments

Payments are processed by Stripe. We do not collect or store your full card details. Your use of checkout is also subject to Stripe's terms. You authorize the charge shown at checkout.

6. Acceptable use

You agree not to:

  • scrape, bulk-download, resell, redistribute, or sublicense data, scores, or content obtained from the Service;
  • attempt to reconstruct or re-host the underlying third-party content (see §7);
  • use the Service to harass, defame, or target any individual, or for surveillance, credit/insurance/eligibility decisions, or profiling of individuals;
  • circumvent quotas, credits, rate limits, or access controls; or
  • use the Service as the sole basis for any trade or financial decision.

7. Third-party data & attribution

X (Twitter) content. Posts, handles, display names, profile images, and follower counts are retrieved through the official X API and remain subject to the X Developer Agreement & Policy. X content belongs to its authors and/or X Corp.; CalledIt displays it for commentary and accountability under X's Display Requirements, with attribution and links back to the original posts on X. We do not sell access to X content, and credits buy CalledIt's own analysis — not the underlying posts. We remove or update stored X content when it is deleted or changed on X, and we honor removal requests from X or an account owner (see §11 and the Privacy Policy).

Market data. Price data is provided by EODHD and is used under their license. Market data may be delayed, incomplete, or inaccurate and is provided without warranty.

8. Intellectual property

The Service — including the classifications, scores, leaderboards, portfolios, and methodology — is our intellectual property. Third-party content (X posts, market data) belongs to its respective owners. We grant you a personal, non-exclusive, non-transferable license to use the Service for your own non-commercial research; no other rights are granted.

9. No warranty

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that any number, classification, or ranking is accurate, complete, or current. See the Disclaimer for the specific limits of our data and methodology.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or trading losses, arising from your use of the Service. Our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless CalledIt and its operators, contributors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any trade, investment, or financial decision you make; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party right. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

12. Removal & corrections

If you are (or represent) an X account shown on CalledIt and believe a number is wrong, or you want your account removed, email [email protected]. We honor verified removal requests from X account owners and X, and we aim to action them promptly (and within 24 hours where required).

13. Termination & changes

We may modify, suspend, or discontinue the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date; continued use after a change means you accept it. We may terminate or suspend access for any violation of these Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Informal resolution first: before starting any formal proceeding, you agree to email [email protected] describing the dispute and to give us 30 days to resolve it in good faith. Venue: any dispute not resolved informally will be brought exclusively in the state or federal courts located in New Jersey, and you and we each consent to personal jurisdiction there. Individual claims only: to the fullest extent permitted by law, claims may be brought only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative action; you and we each waive any right to a jury trial. A binding pre-dispute arbitration provision may be added here with counsel if desired.
